Law V. Citizens

Since the dawn of Man, the law has played an important roll on the progress of civilization. Beginning with Cain, and his assault and murder of his brother Abel.
Though there was no written law forbidding Murder, Cain knew that he had committed a grave injustice to the respect for life in what he’d done.
He received, legal council from God Himself as to the course he was taking and was warned that; if he did not get control of his temper that Sin would over take him.
The fact that he knew it was wrong is evident in his plea to God when he was banished from Eden. Cain threw himself on the mercy of the court and asked he be granted protection from the avenger of death.
Realizing that what was done, was done in the heat of passion God granted Cain clemency from his deed and placed into effect a decree that anyone taking Cain’s life would sacrifice their own.
So what is the law good for and why was it implemented in the first place? The law provides guide lines and restrictions on human behavior. The law recognizes that where there is no written guide line to follow, then there is no law in effect.
Though one of the principle, components of modern law is: Corpus Delicti/ or Body of a crime, Motive, Method, Opportunity, and Intent, the main ingredient in establishing guilt rests on Intent, intent goes to determining the degree of punishment, one should receive for committing the crime itself.
In other words; a person robing a store because they are hungry and want to feed their family, would be judge less harshly than some one robing the same store just for kicks.
The primary flaw with today’s laws and the way the law plays-out against the average citizen is:a lack of adequate punishment for certain crimes. Take the crime of [Rape] standard punishment for the crime of rape should be castration. This would insure that a rapist would not return to the unacceptable behavior.
Especially in case of pedophiles, this should be the case. And this in the case of men only. Why? Rape of a young women is quite different from rapping a young man.
Unlike a woman who’s ability to resist sexual attack is limited to how much power she can muster to ward of her attacker; with young men it takes a certain degree of focus for the woman to complete the act. If a male “victim is not interest and refuse to cooperate on some level, he will not rise to the occasion.
So sexual attack in this case is a gift as opposed to violation through dominance. I am sure a lot of parents of young men; who have been shown the facts of life earlier, than they would have chosen; would disagree...but its surprising to note, that in most cases it’s the parents who press charges. While the young man wears the event like a badge of honor.
The bottom line is: the law was made to serve man and not man made to serve the law. Most law of are era is law for the highest bidder. Whether its murder/ a criminal offense or civil litigation the modern law favors the person who can afford the best lawyer.
Another case that bears a close look, is a law placed on the books that allows the Big Oil companies to used the Enron loophole gouge the public on gas prices.
The law then is only as good as the men and women who represent the law in the courtroom, and the end result of any trial will be the victim or the benefactor, of which ever lawyer is paid the highest price.
The number of murders on the loose right now in America because of a lack of evidence or some technical glitch is freighting. The number of people serving time as the result of a bad plea arrangement made to avoid more extensive time being served is also disturbing.
And sadly none of this will change till we as people, get involved in our own governance and take positive action to change the way the law effects us.
