The information you are about to read is very simple to understand. It's a strategy to help you keep your home. I am a Para-Legal. Simply put my neighbor had negotiated with his mortgage company in good faith and they still refused to modify his loan and proceeded with foreclosure, he filed an injunction and before the judge could help him out they came to the table.
Some judges are sympathetic to the fact that these large mortgage companies are at fault for selling faulty mortgages in the first place; plus the fact that they have taken huge sums of bail out money, and may just give you the reprieve you're looking for; at any rate an injunction will stop the sale date of the foreclosure.
What gives this tactic a high probability of working for you is this: once you stop the initial published sales date the mortgage company needs to start that process all over again. With all of the time constraints that apply.
They are also obligated to heir attorneys, not cheap. So they're forced to expend money that they other wise would not have.
Add to that the high probability of the judge finding in your favor and the mortgage company having to pay for any legal representation you employee and its "cheaper to keep her".
In other words its cheaper to negotiate in good faith, and restructure the loan than to keep bleeding funds.
You can file the injunction yourself but paying a lawyer to provide a [Letter of Intent to Intervene] gives your position validity, and ups the anti for the mortgage company's cash out lay.
At any rate do not for get to prepare and order granting your injunction for the judge to sign, and be sure to approach the Judge's Clerk and request a hearing date to put your injuction in place.
The injunction is no good with out the Court order. the only way to get the order is to schedule a hearing.
Keep good financial records and as-well-as records of telephone calls and who you talked to.

I have been not too long ago facing my own horrors associated with loosing my personal home caused by foreclosure. Therefore i have been wanting to research my personal rights, and learn precisely what might be the top things to do. Reading through your article has really provided me so good insight. Listen: After fighting in court one year and a half, I managed to file 6 motions,including a motion to preserve
evidence, I had all motions except one heard, the judge
threatened sanctions. I had the final one heard. I went through 5 docket soundings and one trial and I had the case dismissed.
Bottom line is that the pen is mightier than the sword and the bank's lack of paperwork can come back to hang them!!!
