FEDERAL LAW CLERKS DECIDING LEGAL CASES JUDGES SIGNING OFF

You’ve got a case in Federal District Court you believe that you’ll get a fairer shake in the court of the land, than in state Court; where local courts are more likely to favor local large law firms.

Put away your wishful thinking. In all likely-hood you may fare worse in the district Federal Court than in the State Court.

The answer for this lies partially in the fact that the congress of the U.S. is not confirming Judicial, nominations as required by law. This monster wears two hats.

One it helps to load the federal bench with activist Judges that are mostly to the right. Two it’s a de-facto way of controlling litigation, they can’t get legislation passed that controls, whether you can sue your physician for malpractice; so they make sure that if your do sue your case will be caught in the back log.

Rather than wait ten years to get what you deserve in a settlement you take what they want to give you and walk away.

But this hub is not about that. What it is about is exactly who is making the case, decision in Federal Court? If you say the federal Judge assigned to your case, guess again.

In more case than we know, the person making the decisions about whether your case, is dismissed or, decided in your favor is, the judges Law Clerk, especially, if you’re a Pro Se, Litigant. Most people know that whether it’s in the judges chambers or the huge corporate legal secretary hall of fame, it’s the paralegals that do the hard work.

What do judges do? Play golf, sit in court listening to attorneys drone on and on, then retire to there chambers, to sign off on the decisions, made by their law clerks, on the cases the refuse to bother with.

Truth is the American Justices system is hopelessly, broken. Through the years attorneys have been able to influence the Rules of Civil Procedure and other aspect of the laws passed by congress, so that procedure now trumps the law.

A defendant can avoid facing the real charges in a case by employing a “good lawyer,” one who knows the judge; handling your case personally, and how to manipulate the rules so that his client never has to deal with the real charges filed.

But the fact that some junior flip who has not even passed the Bar is a judge with out Robes, making decisions that greatly impact the lives of the people represented in the case before the court, is the biggest scam; being perpetrated against the citizens of this country.
